1. Acceptance of Terms

By accessing and using Fire Guidance Genius ("the Service"), operated by Ashton Fire, you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service.

2. Description of Service

Fire Guidance Genius is a collaborative platform for accessing, annotating, and sharing fire safety documentation and resources. The Service allows registered users to:

  • View fire safety documents and guidance
  • Create and share annotations on documents
  • Participate in community discussions
  • Ask the AI assistant questions about the guidance documents
  • Search and organise fire safety information

3. User Accounts

3.1 Account Registration

To use the Service, you must:

  • Be at least 13 years of age
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Promptly update your account information if it changes

3.2 Account Security

You are responsible for all activities that occur under your account. You must:

  • Keep your password secure and confidential
  • Notify us immediately of any unauthorised use of your account
  • Not share your account with others

3.3 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in conduct that we deem harmful to the Service or other users.

4. Acceptable Use

4.1 Permitted Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You also agree to follow our Code of Conduct.

4.2 Prohibited Conduct

You must not:

  • Violate any applicable laws or regulations
  • Infringe upon the rights of others, including intellectual property rights
  • Upload malicious code, viruses, or harmful software
  • Attempt to gain unauthorised access to the Service or other users' accounts
  • Harass, abuse, or harm other users
  • Post false, misleading, or defamatory content
  • Spam or engage in unsolicited advertising
  • Scrape or collect user data without permission
  • Interfere with the proper functioning of the Service
  • Impersonate any person or entity
  • Use the AI assistant for anything other than questions about fire safety guidance
  • Attempt to bypass the AI assistant's safeguards, or to make it produce anything other than answers drawn from the guidance documents

4.3 Using the AI Assistant

The AI assistant answers questions using passages from the guidance documents in the library and cites them. When you use it you agree to:

  • Ask only about fire safety guidance
  • Check important points against the cited guidance before relying on them
  • Apply your own professional judgement: the assistant supports your decisions and never replaces your responsibility for them
  • Apply your employer's or organisation's AI policy alongside ours, following whichever is stricter

5. User Content

5.1 Your Content

You retain ownership of any content you submit to the Service, including annotations, comments, and forum posts ("User Content").

5.2 Licence to Us

By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free licence to use, reproduce, modify, and display your User Content in connection with operating and improving the Service.

5.3 Content Standards

Your User Content must:

  • Be accurate and not misleading
  • Comply with applicable laws and regulations
  • Not infringe upon any third party's rights
  • Not contain offensive, abusive, or inappropriate material
  • Be relevant to fire safety topics

5.4 Content Moderation

We reserve the right to review, moderate, or remove User Content that violates these Terms or that we deem inappropriate. However, we are not obligated to monitor all User Content.

6. Intellectual Property

6.1 Our Property

The Service, including its design, features, and underlying code, is owned by Ashton Fire and may not be copied, reused, or redistributed without our permission.

6.2 Third-Party Content

Fire safety documents and materials available through the Service may be owned by third parties. Your use of such content is subject to any terms specified by the relevant third-party owner.

6.3 Restrictions

You may not:

  • Copy, modify, or create derivative works of the Service
  • Reverse engineer or attempt to extract source code
  • Remove or alter any notices or branding
  • Use our trademarks without permission

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability or fitness for a particular purpose
  • Accuracy, reliability, or completeness of content
  • Uninterrupted or error-free operation
  • Security or freedom from viruses

The information provided through the Service is for informational purposes only and should not be relied upon as professional fire safety advice. Always consult with qualified fire safety professionals for specific guidance.

Answers from the AI assistant are generated automatically. They can be incomplete or wrong and are not professional fire safety advice. You remain responsible for decisions made using them.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIRE GUIDANCE GENIUS SHALL NOT BE LIABLE FOR ANY:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, use, or goodwill
  • Service interruptions or errors
  • User Content or conduct of other users

Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid to us in the 12 months preceding the claim, or £100, whichever is greater.

9. Indemnification

You agree to indemnify and hold harmless Ashton Fire, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your User Content
  • Your violation of these Terms
  • Your violation of any rights of another party

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect and use your information.

12. Modifications to the Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through a notice on the Service. Your continued use of the Service after such changes constitutes acceptance of the revised Terms.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Ashton Fire regarding your use of the Service.
